COOKING EXPERIENCES TERMS & CONDITIONS
01 - COVID-19 POLICIES:
Due to the nature of small businesses in the current pandemic and potential shut downs, we would love to reschedule your projected class to a future date with a credit applied to your account. This helps ensure our survivability past the pandemic.
As part of our continued efforts to protect our guests, Desierto Azul is upholding and following current Covid-19 regulations and best recommendations per our state and federal governments. There is access to a handwashing sink and hand sanitizer at each table and also upon entrance. All table top surfaces have been thoroughly sanitized and wiped down after each and every guest. Face masks are required during the class and in the enclosed spaces of the Hotel. We appreciate everyone's understanding and patience through these trying times.
02 - CANCELLATION POLICY
Desierto Azul Cooking Experiences are 100% refundable up to 30 days prior to the class. Thereafter no refund will be possible. Date changes are permitted up to 7 days prior to the class. Cooking Experiences are always transferable to other persons.
Desierto Azul may cancel the Cooking Experience due to low enrollment, if less than 2 guests are enrolled, or other unforeseen circumstances, such as inclement weather. If a class is cancelled, Desierto Azul will make the determination no less than 2 hours prior to class. We will notify you by phone and/or email using the information provided upon registration. Regarding the cancellation, you may be offered a future Cooking Experience credit or a refund back to the original form of payment. Please allow up to 10 business days for us to process your request.
03 - LIABILITY WAIVER
03.1 Food allergies & medical conditions
As part of the Cooking Experience, you will prepare food items. While the majority of our experiences are gluten-free, lactose-free, and we make every effort to reduce and prevent allergic reactions, you agree to formally inform the staff of any food allergies, at least 5 days prior to your participation. However, there is always a risk of contamination and we cannot guarantee that the premises will be 100% allergens-free. Your payment is your consent of enrolling knowing this information and the possible health risk. You agree and understand that Desierto Azul will seek to eliminate exposure and risk and its instructors assume no liability for adverse reactions for food consumed or items that you come in contact with while participating in any Cooking Experience.
You also agree to inform Desierto Azul and his staff of any medical condition prior to your participation in any activities and to release and hold harmless Desierto Azul for any injury occurring as a result of participating in the Cooking Experience.
By participating in the Cooking Experiences offered at Desierto Azul, you agree and acknowledge that participation naturally involves the risk of injury, which may arise from negligence, fault, or carelessness on the part of the guests, whether you or someone else causes it. Specific risks vary and the risks range from minor injuries to major injuries, such as catastrophic injuries. The typical injuries that may occur include suffering burns, cuts, bruises, muscle strains, and other injuries received due to participating in cooking classes. In consideration of your participation in the Cooking Experiences, you understand and voluntary accept this risk and agree that you release Desierto Azul, from any and all liability including the above-mentioned injuries. Furthermore you recognize that the company, its owners, directors, employees, volunteers, agents, and independent contractors are not responsible for the errors, omissions, acts, or failures of the guests (including yourself).
03.3 Rights to use photo / videos
You agree and acknowledge that both videos and photographs may be taken during the Cooking Experiences in public areas for marketing purposes and agree and acknowledge that you have granted Desierto Azul the rights to use such videos and photographs.
You agree and acknowledge that in case of miss-use of the equipment provided in the Cooking Experience, you may be asked to leave the premises and no refund will be given, and that you must pay in the next 10 business days, for repairs or replacement in case of damage of the above mentioned equipment.
